By accessing the Website or booking any Service, you agree to be legally bound by these Terms. If you do not agree, you must not use the Website or Services.

2. Eligibility

By using our Services, you confirm that:

  • You are at least 18 years old; or
  • You are booking on behalf of a minor and have legal authority to do so.

You agree to provide accurate and complete information during booking.

3. Bookings and Contract Formation

A booking becomes legally binding only when:

  1. We receive payment (full or deposit), and
  2. You receive written confirmation from Qazaq Adventure.

We reserve the right to refuse or cancel any booking at our discretion prior to confirmation.

4. Pricing and Payments

  • All prices are listed in Kazakhstani Tenge (KZT) and USD, unless otherwise stated.
  • Prices may change without prior notice until booking confirmation.
  • Full payment or a deposit may be required at the time of booking.
  • Remaining balances must be paid before the tour departure date.

We are not responsible for additional bank fees, currency conversion charges, or transaction fees.

5. Cancellation and Refund Policy

5.1 Cancellation by Customer

Unless otherwise specified in the tour description:

  • 7+ days before departure: refund minus transaction/processing fees
  • 3–6 days before departure: partial refund (percentage specified at booking)
  • Less than 72 hours before departure: non-refundable

Refunds are processed within 10–14 business days.

5.2 Cancellation by Company

We may cancel or reschedule a tour due to:

  • Severe weather conditions
  • Insufficient number of participants
  • Safety concerns
  • Government restrictions
  • Force majeure events

In such cases, customers may choose either:

  • A full refund, or
  • Rescheduling to another available date.

6. Assumption of Risk and Participant Responsibility

Our tours may involve outdoor and adventure activities, including but not limited to:

  • Hiking
  • Off-road travel
  • Mountain terrain
  • Water-related activities
  • Uneven natural surfaces

By booking a tour, you acknowledge that:

  • Participation involves inherent risks.
  • You voluntarily assume all associated risks.
  • You are physically and medically fit to participate.

Participants must follow all safety instructions provided by guides. Failure to comply may result in removal from the tour without refund.

7. Health and Medical Conditions

You must inform us prior to departure of:

  • Medical conditions
  • Physical limitations
  • Allergies
  • Dietary restrictions

We reserve the right to refuse participation if a medical condition may pose a risk to the individual or the group.

8. Travel Insurance

We strongly recommend that all participants obtain comprehensive travel insurance covering:

  • Medical expenses
  • Personal injury
  • Trip cancellation
  • Loss or theft of belongings

Unless explicitly stated, Qazaq Adventure does not provide individual travel insurance coverage.

9. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages.
  • We are not responsible for acts or omissions of third-party providers.
  • We are not liable for loss, theft, or damage to personal belongings.

Our total liability shall not exceed the amount paid by you for the specific Service.

Nothing in these Terms excludes liability where exclusion is prohibited by law.

10. Force Majeure

We shall not be held liable for failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters
  • Extreme weather
  • Political instability
  • Pandemics
  • Government restrictions
  • Road closures

11. Photography and Media Use

During tours, photos and videos may be taken for promotional purposes.

By participating, you grant Qazaq Adventure a non-exclusive, royalty-free right to use such media in marketing materials, including website and social media.

If you do not wish to appear in promotional materials, you must notify us in writing before the tour.

12. Intellectual Property

All Website content, including text, images, branding, logos, and design elements, is the property of Qazaq Adventure and is protected by intellectual property laws.

Unauthorized use, reproduction, or distribution is prohibited.

13. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Kazakhstan.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Kazakhstan.

14. Amendments

We reserve the right to update or modify these Terms at any time. The updated version will be published on this page with a revised effective date.

Continued use of the Website constitutes acceptance of the updated Terms.
